General Terms and Conditions
Orders, commissions and deliveries from or to the customer (hereinafter "you" or "purchaser") for spare parts, accessories and other products and services (hereinafter "goods") are carried out in accordance with these General Terms and Conditions of Business and Delivery (hereinafter "Terms").
The seller of the goods is DMS-Weinheimer Küchen, owner Markus Thönnes, Wintergasse 87, 69469 Weinheim (hereinafter referred to as "we" or "DMS-Weinheimer Küchen").
The statutory warranty is 2 years for new parts and 1 year for used parts.

If you wish to purchase goods in your capacity as a consumer, the "General Terms and Conditions" and the "Special Terms and Conditions for Consumers" apply. For the purposes of these terms and conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity.
If you wish to purchase the goods in your capacity as a business owner, the "General Terms and Conditions" and the "Special Terms and Conditions for Business Owners" apply. For the purposes of these terms and conditions, a business owner is a natural or legal person or a legally recognized partnership that, when entering into a legal transaction, is acting in the course of its commercial or independent professional activity.
If the goods you have ordered are spare parts, for safety reasons they should only be installed by a professional, unless we expressly advise otherwise.
We generally ship our goods within Germany and to member states of the European Union. Furthermore, we also deliver – by individual agreement – to countries outside the European Union (third countries) and internationally.
Deliveries to non-EU countries are subject to the respective customs regulations and import requirements of the receiving country. Any additional customs duties, taxes, import charges, or other fees are to be borne by the customer unless expressly agreed otherwise.
We reserve the right to exclude deliveries to certain countries in individual cases if there are legal, logistical or economic reasons to the contrary.
The contract data we collect will be used exclusively for the purpose of processing the contract, unless further consent or a legitimate interest exists.
The goods remain our property until full payment is received.

Special conditions for consumers
Delivery
Delivery is carried out by a transport company commissioned by us. If you provided your email address when placing your order, we are authorized to pass this on to the shipping company so that they can inform you about the shipment status.

Cancellation policy for consumers
Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The cancellation period is fourteen days from the day on which you or a third party named by you took possession of the last item.

Inform them of your decision by means of a clear statement (e.g. letter or email).
To meet the deadline, it is sufficient that you send the notification before the deadline expires.
Consequences of the revocation
If you cancel the contract, we will refund all payments received from you, including delivery costs (excluding additional costs incurred due to a delivery other than the cheapest standard delivery), within fourteen days of receiving your cancellation notice.
We may refuse to issue a refund until we have received the goods back or you have provided proof of return.

Special conditions for entrepreneurs
Any differing terms and conditions of the customer are only valid if we expressly acknowledge them in writing.
The risk passes to the buyer as soon as the goods leave our shipping point.
Defects must be reported in writing without delay in accordance with § 377 of the German Commercial Code (HGB):

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Repair conditions
The following conditions apply to all repair work carried out by DMS-Weinheimer Küchen .
An order only comes into effect through our express acceptance.
The work will be carried out by appointment. Appointments are non-binding.
Repairs that cannot be completed for reasons beyond our control will still be subject to a charge.
We do not carry out any work on the kitchen cabinetry and do not undertake any carpentry work.
Replaced parts become our property.
The price is due immediately and must be paid on site in cash or by debit card.
Liability
Except in cases of breach of essential contractual obligations, injury to life, body or health or under the Product Liability Act, we are only liable for intent and gross negligence.
Final Provisions
Should individual provisions be invalid, the remainder of the contract shall remain valid.
The place of jurisdiction is Weinheim , insofar as legally permissible.
